East Tennessee > Lawsuit Against Alcoa Mitsubishi by One of the Partners

The Mitsubishi dealership on Airport Highway closed recently. Melissa had told me about it and some of the hinky dealings there. The state is investigating, and one of the partners is suing. The Daily Times has the story. The lawsuit is revealing more details about what happened.

The lawsuit accuses the defendants of breach of contract, fraud, conspiracy and violation of the Tennessee Consumer Protection Act, among other allegations.

According to the suit, Kent and K&M Automotive contacted Pack in early 2005, offering to sell him an Alcoa Highway automotive dealership known as Alcoa Mitsubishi. Pack entered into an agreement to purchase the dealership on Feb. 23.

At the time of this agreement, the suit alleges, Kent and K&M ``did not disclose to (the plaintiff) Alcoa Mitsubishi's true financial condition, history of profitability or (defendant Kent and K&M's) scheme and conspiracy to use the capital of Pack and his corporation to remedy the defendants' prior business practices and financial improprieties.''

My daughter is caught up in this fraud. She is a college student who had never paid a bill late and she is on the brink of bankruptcy. I am wondering if anyone has found any relief? She has an attorney and has filed a lowsuit but did anyone get the cars back that Alcoa Mit. sold and did not pay off?

sue darrell lynn cooper and tracy scott pack and bill kent, bill kent was still the true owner, scott pack's buy/sell agreement never was null and void and darrell lynn cooper was the one running the place. furthermore there were over 25000 worth of gap insurance policies and extended warranties that were never registered and paid for

I paid cash for a used car fro Alcoa Mitsubishi in the fall of 2005 (right before they got shut down). Never got the title ... cannot register vehicle. Need the name of an attorney that might be familiar with the case (i.e. know who to sue). e-mail if you know an attorney that might be able to help.
